Rhinomed Limited ACN 107 903 159 and its wholly owned subsidiary ASAP BreatheAssist Pty Ltd ACN 103 385 726 (“Rhinomed/We/Us/Our”) owns and operates the website(s) www.theturbine.com, www.mutesnoring.com, www.rhinomed.global, www.rhinomedshop.com, us.rhinomedshop.com, uk.rhinomedshop.com and www.dxhealth.com.au. You agree that your use of these websites constitutes your consent for us to use your Personal Information, in accordance with this Privacy Policy. 

We respect your privacy

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully in accordance with this Privacy Policy and the Privacy Act 1988 (Cth). We collect information about you for two principal reasons: firstly, to process your orders or requests and secondly, to provide you with the best service possible. “Personal information” is information we hold which is identifiable as being about you. This includes information such as your name, email address, identification number, or any other type of information that can reasonably identify an individual, either directly or indirectly. Personal information we collect on our websites and in our applications are sent to our servers and may be processed by us in Australia where laws regarding processing of personal information may be less stringent than the laws in other countries.

Our websites

Information you provide to us on our website that is capable of identifying an individual. This includes your first and last name, email address, postal addresses, password if you submit a form or create an account, and payment information if you purchase a product on our website.

We automatically collect the following information on our site:

Your Internet protocol address (“IP address”), browser type, domain names, access times, and operating system. We also use cookies and navigational data like Uniform Resource Locators (URLs) to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. This type of information is collected to make our products and services more useful to you. In some of our emails to you, we will use a “click-through URL” to make your experience as easy as possible. When you click on one of these URLs, our web server detects that you clicked on the link from your email before arriving at your destination website. Tracking click-throughs helps us determine your interest in particular topics and helps us measure the effectiveness of our customer communications. 

Cookies are small pieces of information that a website sends to your computer’s hard drive while you are viewing a website. We may use both session Cookies (which expire when you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the website. We also collect information about you during the checkout process on our store(s). While you visit our site, we’ll track:

When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

  • Respond to your requests, including refunds and complaints 
  • Process payments and prevent fraud 
  • Set up your account for our store 
  • Comply with any legal obligations we have, such as calculating taxes

If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders. 

We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will store order information for 7 years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses. 

We will also store comments or reviews, if you choose to leave them.

Personal information we get from other sources 

We may get Personal Information about you from other sources. We may add this information to the information we have already collected from you in order to improve the products and services we provide. 

USE OF INFORMATION

Rhinomed uses your Personal Information to provide and deliver products and services you request; personalise your experience and customise content, marketing, and recommendations; respond to requests that you make, provide you with customer service, send you press releases, general informative announcements, and promotional information about us or our products, or to aid us in serving you better; and protect, investigate, and deter against fraudulent, unauthorised, or illegal activity. 

If you withhold your personal information, it may not be possible for us to provide you with our products and services or for you to fully access our website.

SHARING OF INFORMATION

Rhinomed may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this privacy policy. If we do disclose your personal information to a third party, we will protect it in accordance with this privacy policy. 

Who on our team has access 

Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:

  • Order information like what was purchased, when it was purchased and where it should be sent, and 
  • Customer information like your name, email address, and billing and shipping information. 
  • Our team members have access to this information to help fulfil orders, process refunds and support you.

Improving our service

Rhinomed does not sell, trade or rent your Personal Information to others. To better tailor our services to our customers’ needs, we use non-identifying and aggregate information to help us make decisions on how to improve Rhinomed. We also share this generic information with our advertisers and other interested, reputable parties with whom we have established a formal business relationship. For example, we may tell advertisers which areas of the website have received the most customer traffic overall, or more specifically, how many customer types have visited certain pages. However, we do not disclose Personal Information that is capable of identifying individual customers to advertisers.

Newsletter subscriptions 

Your email address will be used for our own marketing purposes until you unsubscribe. It is possible to unsubscribe at any time. If you do not wish to receive information about our products or services you can unsubscribe by clicking the unsubscribe link, which exists on all marketing emails sent by Rhinomed.

Comments & Reviews 

When visitors leave comments or reviews on our sites we collect the data shown in the comment or review form, and also the visitor’s IP address and browser user agent string to help spam detection. 

An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment or review, your profile picture is visible to the public in the context of your comment or review.

Cookies 

If you leave a comment or review on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year. 

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

Embedded content from other websites 

Articles on our websites may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. 

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Analytics tools 

Google Analytics is a system used by many websites to record information about who visits a website. Google set five different cookies with expiry dates ranging from 1 day to 2 years. These cookies are used mainly to differentiate between first time visitors to a website and repeat visitors. They do not contain any personally identifiable information. Rhinomed may from time to time share your details with third party analytical resources for the purposes of better understanding customer behaviour and performance, website performance and any other analytical process to give Rhinomed a better understanding of how to develop its offering to its customers. These third parties will be employed solely for the purpose of the aforementioned analytical purposes, and as such Rhinomed will ensure that the third party is contractually obliged to use the data only for the analytical purposes set out in the agreement between Rhinomed and the third party, and Rhinomed will also ensure that the third party is contractually required to maintain a level of security around the shared data, at least as safe as Rhinomed itself employs. Failure on the part of the third party to meet its contractual obligations will result in Rhinomed recovering the data, and taking all reasonable actions to ensure the third party no longer has access to the shared data. 

Shipping providers 

If you’ve made a purchase through a Rhinomed online store, we transmit some of your data to a third party shipping platform provider and select couriers, as well as our inventory management system.

Social media plug-ins

Social media plug-ins for Facebook, Instagram and Twitter are present on some of our websites and obtain data for tracking purposes. 

YOUR CONSENT 

By submitting information to Rhinomed you consent to the collection and use of this information by Rhinomed and its Service Provider (if any) in the fulfilment of your order. If we decide to change our privacy policy, we will post those changes on this page so that you are aware of what information we collect, how we use it and under what circumstances we disclose it. 

DATA SECURITY 

We have designed our site to protect the information we collect online from unauthorised access. We safeguard your private information by implementing the appropriate physical, electronic and managerial procedure necessary to protect your privacy. To further protect your security, we also take the reasonable steps to verify your identity before granting access to your personal profile or making data changes. We are committed to protecting your privacy and have security measures in place to prevent unauthorised access to and disclosure of your personal information. 

Security capabilities and policy for transmission of payment card details 

We do not record or store cardholder information and data. Credit card details are provided directly to Stripe or PayPal for processing. All transactions are processed through 128 bit SSL encryption. When processing payments, some of your data will be passed to Stripe or PayPal, including information required to process or support the payment, such as the purchase total and billing information. 

International privacy 

The above privacy statement may not be applicable in all countries of Rhinomed visitors or registered community users, as security policies may vary according to the individual Internet laws in each host country. 

GENERAL DATA PROTECTION REGULATION (GDPR) FOR THE EUROPEAN UNION (EU) 

Rhinomed will comply with the principles of data protection set out in the GDPR for the purpose of fairness, transparency and lawful data collection and use. 

We process your personal information as a Processor and/or to the extent that we are a Controller as defined in the GDPR.

We must establish a lawful basis for processing your personal information. The legal basis for which we collect your personal information depends on the data that we collect and how we use it. 

We will only collect your personal information with your express consent for a specific purpose and any data collected will be to the extent necessary and not excessive for its purpose. We will keep your data safe and secure. 

We will also process your personal information if it is necessary for our legitimate interests, or to fulfil a contractual or legal obligation. 

We do not collect or process any personal information from you that is considered “Sensitive Personal Information” under the GDPR, such as personal information relating to your sexual orientation or ethnic origin.

You must not provide us with your personal information if you are under the age of 16 without the consent of your parent or someone who has parental authority for you. We do not knowingly collect or process the personal information of children.

HOSTING AND INTERNATIONAL DATA TRANSFERS 

Information that we collect may from time to time be stored, processed in or transferred between parties or sites located in countries outside of Australia. These may include, but are not limited to Australia, the United States, and the United Kingdom.

We and our other group companies have offices and/or facilities in Australia, the United States and the United Kingdom. Transfers to each of these countries will be protected by appropriate safeguards, these include one or more of the following: the use of standard data protection clauses adopted or approved by the European Commission which you can obtain from the European Commission Website; the use of binding corporate rules, a copy of which you can obtain from Rhinomed’s Data Protection Officer. 

The hosting facilities for our website are situated in Australia and the United States. Transfers to each of these Countries will be protected by appropriate safeguards, these include one or more of the following: the use of standard data protection clauses adopted or approved by the European Commission which you can obtain from the European Commission Website; the use of binding corporate rules, a copy of which you can obtain from Rhinomed’s Data Protection Officer. 

Our Suppliers and Contractors are situated in Australia, the United States and the United Kingdom and other countries around the world. Transfers to each of these Countries will be protected by appropriate safeguards, these include one or more of the following: the use of standard data protection clauses adopted or approved by the European Commission which you can obtain from the European Commission Website; the use of binding corporate rules, a copy of which you can obtain from Rhinomed’s Data Protection Officer. 

You acknowledge that personal data that you submit for publication through our website or services may be available, via the internet, around the world. We cannot prevent the use (or misuse) of such personal data by others. 

SECURITY OF YOUR PERSONAL INFORMATION 

Rhinomed is committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure. 

Where we employ data processors to process personal information on our behalf, we only do so on the basis that such data processors comply with the requirements under the GDPR and that have adequate technical measures in place to protect personal information against unauthorised use, loss and theft. 

The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy. 

ACCESSING YOUR PERSONAL INFORMATION DATA 

If you would like to get a copy of the Personal Information data we have stored for you, would like that data updated or deleted, please email privacy@rhinomed.global. We will confirm your identity and proceed to provide this data within a reasonable period of time. 

COMPLAINTS ABOUT PRIVACY

If you have any complaints about our privacy practices, please feel free to send in details of your complaints to privacy@rhinomed.global. We take complaints very seriously and will respond shortly after receiving written notice of your complaint.
